1. Website Ownership
This website portal and its subdomains (hereinafter, the “Portal”) are the property of BIOTFY SOLUTIONS, S.L. (hereinafter, “BIOTFY”), with Tax Identification Number (CIF) B21779905 and registered address at Calle Loma de los Riscos 59, 29620 Torremolinos (Málaga), Spain, duly registered in the Mercantile Registry of Málaga, Section 8, Sheet MA189791.

2. Purpose and Acceptance of the Terms of Use
BIOTFY provides the public (hereinafter, the “User”) accessing the Portal with information regarding its products and services, primarily the software platform “BIOTFY” offered as Software as a Service (SaaS), designed to efficiently monitor and manage ecosystems, delivering real-time data and analytics.
Accessing and using the Portal implies the full and unreserved acceptance of these general conditions of use (hereinafter, the “Terms of Use”), as well as BIOTFY’s Privacy Policy and Cookie Policy. The User is advised to read these conditions carefully before browsing the Portal. If the User does not agree with any of the clauses, they must refrain from using the Portal.
3. Software License Agreement (BIOTFY Platform)
Access to and use of the “BIOTFY” software platform is governed by a specific Software as a Service License Agreement. This license sets out the terms and conditions under which BIOTFY grants the Client the right to access and use the Platform, including its functionalities, restrictions, party liabilities, intellectual property, and other relevant aspects.
Acceptance of this Legal Notice, which governs the conditions of use for the Portal, does not substitute or exempt the Client from reading and accepting the aforementioned license in the General Terms and Conditions of Contracting prior to contracting and using the BIOTFY Platform services.
4. Correct Use of Portal Services
The User agrees to use the services and contents of the Portal diligently, correctly, and lawfully, and specifically undertakes to refrain from:
- Using the services for purposes or effects that are contrary to law, morality, generally accepted good customs, or public order.
- Reproducing, copying, distributing, allowing public access through any form of public communication, transforming, or modifying the services or contents, unless authorized by the holder of the corresponding rights or legally permitted.
- Performing any act that may be considered an infringement of any intellectual or industrial property rights belonging to BIOTFY or third parties.
- Using the services and, in particular, the information obtained through the Portal to send advertising, direct sales communications, or communications for any other commercial purpose, unsolicited messages aimed at a plurality of people, or commercializing or disclosing such information in any way.
- Introducing or spreading computer viruses or any other physical or logical systems on the network that are capable of causing damage to the physical or logical systems of BIOTFY, its suppliers, or third parties.
The User shall be liable for damages of any kind that BIOTFY may suffer as a result of a breach of any of the obligations set forth above, as well as any others included in these Terms of Use or imposed by law regarding the use of the Portal.
BIOTFY will ensure compliance with the current legal framework at all times and shall be entitled to interrupt, at its sole discretion, the service or exclude the User from the Portal in the event of an alleged commission of a crime or offense under the current Criminal Code, or in the event of observing any behavior that, in BIOTFY’s judgment, is contrary to these Terms of Use or may disrupt the proper functioning, image, credibility, and/or prestige of BIOTFY.
5. Intellectual and Industrial Property
All contents of the Portal, including, but not limited to, texts, opinion articles, graphics, photographs, logos, icons, images, as well as graphic design, source code, and software, are the exclusive property of BIOTFY or third parties who have authorized their use to BIOTFY, and are protected by national and international intellectual and industrial property legislation.
The use of any industrial and intellectual property elements for commercial purposes, as well as their distribution, modification, alteration, or decompilation, is strictly prohibited without the express written authorization of BIOTFY.
BIOTFY informs that some of the images used on this Portal, as well as in other commercial or advertising materials, may have been fully or partially generated using artificial intelligence tools. These images serve an illustrative, artistic, or conceptual purpose and do not necessarily represent real scenes or existing people. BIOTFY is committed to ensuring transparency in the use of this type of content and to informing users when the use of AI-generated images could lead to error or confusion with real content. The company uses only artificial intelligence tools that hold a valid license and respect the intellectual property and image rights of third parties.
6. Exclusion of Warranties and Liability
BIOTFY reserves the right to interrupt access to the Portal’s services at any time and without prior notice, whether for technical, security, control, maintenance reasons, power supply failures, or any other justified cause.
Consequently, BIOTFY does not guarantee the reliability, availability, or continuity of the Portal or its services; therefore, the User’s use of the same is carried out at their own risk, and BIOTFY cannot be held liable in this regard at any time.
BIOTFY assumes no liability arising from, including but not limited to:
- The use that Users make of the materials available on the Portal, whether prohibited or permitted, in violation of intellectual and/or industrial property rights of the Portal’s own content or third-party content.
- Any damages to Users caused by the normal or abnormal functioning of search tools, the organization or location of contents, and/or access to services, and, in general, errors or problems generated in the development or implementation of technical elements forming part of the service.
- The contents of pages that Users can access from links included on the Portal.
- The acts or omissions of third parties, regardless of whether these third parties are contractually bound to BIOTFY.
Furthermore, BIOTFY excludes any liability for damages of any kind that may be due to the presence of viruses or other harmful elements in the content that may cause alterations in computer systems, as well as in documents or systems stored within them.
7. Links to Other Websites
The Portal may include links to third-party websites. BIOTFY does not guarantee nor assume any liability for damages suffered through access to third-party services/content via connections or links on linked sites, nor regarding their accuracy or reliability. The function of the links appearing on BIOTFY is exclusively to inform the User about the existence of other information sources on the Internet where they can expand upon the services offered by the Portal. BIOTFY shall in no case be responsible for the results obtained through such links or the consequences arising from the User’s access to them.
The placement of hyperlinks for commercial purposes on websites external to BIOTFY that allow access to this Portal is expressly prohibited without the express consent of BIOTFY. In any case, the existence of hyperlinks on websites external to the company shall not imply the existence of commercial or business relationships with the owner of the website where the hyperlink is established, nor acceptance by BIOTFY.
8. Personal Data Protection and Use of Cookies
In accordance with data protection regulations, we inform you that the personal data you provide us through our Portal or via email will be processed by BIOTFY SOLUTIONS, S.L. in its capacity as Data Controller, under the legitimacy granted by the consent provided by the User for the purposes described in the Privacy Policy, which must be read, understood, and accepted for the use of this website Portal.
Where applicable, you may exercise your rights of access, erasure, rectification, objection, restriction of processing, and data portability by writing to the company, either at the address indicated above or via email at info@biotfy.com, provided you prove your identity. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD).
BIOTFY undertakes to comply with its obligation of confidentiality regarding personal data, having adopted the necessary measures to prevent its alteration, loss, unauthorized processing, or access, taking into account the state of technology at all times.

9. Applicable Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with Spanish law. For any interpretive or litigious matters that may arise, the parties expressly submit, waiving any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of the city of Málaga, Spain.
